1. Acceptance of Terms

By downloading, installing, or using Pathiary ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Pathiary is a mobile application that helps users create and organize travel journals using AI-powered features including:

• Photo organization and caption generation
• Trip summary creation
• Voice journal transcription
• Interactive world map visualization

3. User Accounts

Some features may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Subscriptions and Payments

4.1 Subscription Plans

The App offers free and premium subscription tiers (Explorer and Wanderer) with different feature limits and capabilities.

4.2 Billing

Subscriptions are billed through your Apple App Store account. By purchasing a subscription, you agree to the pricing and payment terms presented at the time of purchase.

4.3 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your App Store account settings.

4.4 Refunds

Refunds are handled by Apple according to their refund policies. We do not process refunds directly.

5. User Content

5.1 Your Content

You retain ownership of all photos, journal entries, and other content you create or upload to the App ("User Content").

5.2 License Grant

By using the App, you grant us a limited license to process your User Content solely for the purpose of providing App functionality (e.g., generating AI captions and summaries).

5.3 Content Responsibility

You are solely responsible for your User Content and must ensure it does not violate any laws or third-party rights.

6. AI-Generated Content

The App uses artificial intelligence to generate captions, summaries, and other content. You acknowledge that:

• AI-generated content may not always be accurate or appropriate
• You should review AI-generated content before sharing
• We do not guarantee the accuracy, quality, or suitability of AI-generated content

7. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Upload content that infringes on others' intellectual property rights
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App to harass, abuse, or harm others
• Circumvent any usage limits or restrictions
• Use automated systems or bots to access the App

8. Intellectual Property

The App, including its design, features, and content (excluding User Content), is owned by Pathiary and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHIARY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless Pathiary from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of material changes through the App or via email.

13. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms or for any other reason at our discretion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
